Classification from the First Schedule to the BNSS, 2023. *For theft of property worth less than ₹5,000 by a first offender who returns it, BNS 303(2) provides community service, and the Schedule lists that case as non-cognizable and bailable.
Three numbers that trip people up
- BNS 302 is not murder — it is uttering words to wound religious feelings. Murder is BNS 103.
- BNS 316 is criminal breach of trust, not cheating. Cheating is BNS 318. See BNS section for cheating.
- The BNS has only 358 sections, so there is no BNS 376 — rape (old IPC 376) is BNS 64.
